Cannabis & Kratom in Thailand: What's Actually Legal in 2026
The 2022 "weed is legal in Thailand" headlines are two rule changes out of date. Here's the current law for visitors — and why kratom is the opposite story.

Cannabis: how we got here
2022: Thailand delisted cannabis, and some 18,000 dispensaries opened in the legal vacuum — the era the internet still remembers. 25 June 2025: the Health Ministry reclassified cannabis flower as a controlled herb under traditional-medicine law: sales became prescription-only. January 2026: follow-up regulations required medical supervision at every dispensary — and by February 2026 roughly 7,300 of the country's 18,400 shops had shut rather than comply, leaving about 11,000 licensed survivors.
What that means in practice: dispensaries are still visible in tourist areas, but the legal route now runs through a consultation — a Thai-licensed practitioner issues the PT33 prescription for qualifying conditions, sometimes on-site at larger clinics. A shop that sells to anyone who walks in is breaking the rules, and the buyer shares the risk: fines up to ฿25,000 and up to three months' imprisonment apply to unprescribed purchase, public consumption and buying from unlicensed sellers.
Non-negotiables regardless of paperwork: no public smoking, no driving under the influence, and never, ever take any across a border — airport included. Departure screening treats it as trafficking.
Kratom: the opposite trajectory
Kratom — the Southeast Asian leaf chewed and brewed as a mild stimulant — went the other way: off the narcotics list in 2021, then fully regulated by the Kratom Plant Act of 2022. Adults can legally buy leaves and kratom tea from licensed vendors, with no personal possession limit, and tourists are under the same rules as locals.
The boundaries: no sales to under-18s or pregnant women, no mixing into drug cocktails (the notorious "4×100" blend with cough syrup remains illegal), and no import/export without a Narcotics Control Board license. The bigger catch for visitors is at home: kratom is banned or controlled in many countries — check before you even think about bringing any back.
